General Terms and Conditions: **** Please Note: All prices are subject to change and are based on availability. **** These terms and conditions may be changed from time to time by Cobbles and Clover Travel Company LLC (“Cobbles and Clover”). By using this Site, you signify your assent to these Terms and Conditions. If you do not agree to all of these Terms and Conditions, do not use this Site. 1. VERIFICATION: Please check the information that is provided by you to Cobbles & Clover carefully. Cobbles & Clover is not responsible to review or verify the accuracy of the information that you provide. You are responsible for providing the information required for the booking and for the correctness and accuracy of the information provided including passport information, health information and age of participants. Cobbles & Clover is not liable for any fees, costs or losses associated with errors, omissions, inaccuracies, or incomplete information provided by the Client or information not provided in a timely manner. 2. PAYMENT: Cobbles & Clover reserves the right to increase prices due to changes in airfare, other transportation, taxes, fees, permit fees, fuel charges, currency fluctuation and availability. 3. DOCUMENTATION: U.S. citizens traveling to any destination outside of the United States will be required to present a valid U.S. passport. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. All names on documents must match the legal name on your photo I.D., and travel document information must match airline tickets and other travel manifests. Many countries require your passport to be valid for six months or more after your date of entry. Some countries require a visa for transit or entry. Clients are responsible to ensure that they have all the proper documents for entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel. Please check the State Department website at https:// travel.state.gov for further information. Immunizations may also be required. Failure to comply with these regulations may result in denied boarding, denied entry, and/or government imposed fines. If you are a citizen of another country, there may be additional requirements. Check with the nearest consulate or embassy of the destination you are traveling to and find out the entry requirements for non-U.S. citizens. 3. SUPPLIERS: Cobbles & Clover merely acts as a booking agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary or confirmation (“Suppliers”). Cobbles & Clover does not operate, control, or otherwise take responsibility for the Suppliers and is not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, failure to provide services or refunds, financial default, or failure to honor future trip credits. Cobbles & Clover acts only as agent for the client in acquiring transportation, hotel accommodations, sightseeing and other privileges, or services. 4. RISKS OF TRAVEL AND RELEASE: Cobbles & Clover assumes no responsibility for and shall not be liable for the acts or omissions of any other party, or the suitability for a person for any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on "Find International Travel Information” then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. YOU HEREBY EXPRESSLY ASSUME ALL OF THE RISKS AND DANGERS RELATED TO YOUR TRAVEL, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD COBBLES & CLOVER, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, COSTS, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH YOUR TRAVEL, INCLUDING THE ACTIONS AND INACTIONS OF COBBLES & CLOVER TAKEN PURSUANT TO THESE TERMS AND CONDITIONS. YOU AGREE THAT THIS RELEASE SHALL BE BINDING ON YOURSELF AND YOUR TRAVEL PARTY, AND EACH OF THE RESPECTIVE HEIRS, SUCCESSORS, ASSIGNS AND LEGAL REPRESENTATIVES OF YOU AND YOUR TRAVEL PARTY. YOU AGREE TO INDEMNIFY AND HOLD COBBLES & CLOVER HARMLESS FROM ANY COST, LOSS, LIABILITY OR EXPENSE (INCLUDING WITHOUT LIMITATION REASONABLE ATTORNEYS' FEES AND EXPENSES) INCURRED IN CONNECTION WITH YOUR BREACH OR YOUR TRAVEL PARTIES' BREACH OF THESE TERMS AND CONDITIONS. 5. FORCE MAJEURE: Cobbles & Clover is not responsible for the death, injury, illness, delay, loss or damage to person or property, financial costs, or failure to perform or complete any duty or obligation if such issue is caused by an act of God, war, terrorist activity or threat, political or government action, mechanical breakdown, strike, riot, transportation cancellation, natural disaster, pandemic, fire, extreme weather, or any other cause beyond our control. 6. CHARGES AND PRICE CHANGES: You agree to pay the travel planning, change, and other fees charged by Cobbles & Clover. All of our fees are non-refundable. If a Supplier cancels a trip after booking, we will try to assist you with rebooking if the Supplier allows it, and a fee may apply. We do not guarantee any refunds or successful rebooking. Price Increases: Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the Supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you agree to review and comply with such terms. 7. CREDIT CARD MERCHANT: We strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased. However, if we are the credit card merchant, our role is to facilitate the sale, collect funds, and remit those funds to the Suppliers. If the Suppliers do not provide the services, your only recourse is against the Suppliers, and you agree not to initiate a chargeback against us. If we receive a payment instruction authorized by you and the instruction is erroneous in any way, Cobbles & Clover and the Supplies shall have no obligation or liability whatsoever for the error. You are solely responsible for the accuracy and completeness of the transactions you transmit via credit cards. You agree to abide by all applicable laws ("Laws") and any rules applicable to financial clearing houses including, but not limited to, the Automated Clearing House (ACH) rules and National Automated Clearing House Association ("NACHA") rules and any applicable bank, credit and charge card association rules, such as the Visa™ and MasterCard™ Association rules (collectively, “Rules”). You acknowledge that Cobbles & Clover or any Supplier can reject a transaction if it is not in compliance with both the Laws and Rules. YOU ACKNOWLEDGE AND UNDERSTAND THAT THE INTERNET AND ELECTRONIC FINANCIAL PROCESSING IS NOT AN UNFAILINGLY SECURE ENVIRONMENT. You are encouraged to obtain fraud protection for your financial accounts, bank, and credit card accounts. You agree to regularly and promptly review and verify all transactions including the monthly statements received from your bank and credit card issuer holding the account(s). If your bank or credit card statement shows transactions by us that you did not authorize, contact your bank/card issuer immediately. YOU ARE SOLELY RESPONSIBLE FOR ANY UNAUTHORIZED TRANSFERS. 8. CLAIMS DEADLINE AND EXCLUSIVE JURISDICTION: You agree to present any claims against Cobbles & Clover within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that the courts in Middlesex Country, Commonwealth of Massachusetts, will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts. The Terms and Conditions are governed by Massachusetts law without effect to its conflict of law principles. 9. INSURANCE: I hereby verify that I have reviewed my travel itinerary for accuracy. I have been advised of all applicable fees imposed by Cobbles & Clover and the Suppliers, plus I have been offered the option of purchasing trip cancellation/interruption insurance. For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Please note that, unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy. I understand that discounted fares and vacation packages typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money.
